Welcome to BidCeylon. Please read these Terms of Service carefully before using the Platform. These terms set out the rules for using our auction and business directory services.
BidCeylon ("we", "us", "our", "the Platform") is an online auction and business directory platform operating in Sri Lanka. We connect buyers and sellers for peer-to-peer auctions and allow verified businesses to showcase their products. By creating an account or using BidCeylon, you ("you", "the user") agree to these Terms of Service. If you do not agree, please do not use the Platform.
You must be at least 18 years old and legally able to enter into contracts under the laws of Sri Lanka to use BidCeylon. By registering, you confirm that the information you provide is accurate and that you are using the Platform for lawful purposes only.
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or harm other users or the Platform.
When you place a bid, you are making a binding commitment to purchase the item at your bid price if you win. The highest valid bid when an auction ends wins, subject to any reserve price set by the seller. Sellers must accurately describe their items. Once an auction receives a bid, the listing is locked and cannot be edited, to protect bidders. Bids cannot be retracted except at our discretion in exceptional circumstances.
Sellers are responsible for the accuracy of their listings, the legality of the items they sell, and for delivering items as described to winning buyers in a timely manner. Prohibited items include anything illegal under Sri Lankan law, counterfeit goods, stolen property, and items we deem unsafe or inappropriate. We reserve the right to remove listings and suspend sellers who breach these rules.
BidCeylon charges a 5% commission on the final sale price of successful peer-to-peer auction sales. If an item does not sell, no commission is charged. Verified business directory listings may be subject to separate listing or subscription fees, which will be communicated to the business. All fees are stated in Sri Lankan Rupees (LKR).
Payments on BidCeylon are processed through third-party payment providers. For auction purchases, buyer payments may be held by BidCeylon until the buyer confirms receipt of the item, after which funds (less commission) are released to the seller. This holding process is a service we provide to increase trust and is not a regulated escrow or banking service. You acknowledge that payment processing involves third parties whose own terms apply, and that transfer timelines may vary.
Verified businesses may list products that direct buyers to the business's own external website or contact details to complete a purchase. BidCeylon is not a party to transactions that occur off-platform on a business's own site, and we are not responsible for those transactions, the products sold, or the conduct of those businesses. Buyers transact with external businesses at their own discretion.
BidCeylon provides a platform for users to transact but is not a party to the actual contract of sale between buyers and sellers. While we may assist in resolving disputes at our discretion, we are not obligated to do so and are not liable for the outcome of any transaction between users.
BidCeylon is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including losses from transactions, listings, technical issues, or the conduct of other users. Our total liability for any claim is limited to the fees you paid us in connection with the relevant transaction.
We may update these Terms from time to time. Material changes will be communicated through the Platform. Continued use of BidCeylon after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Sri Lanka. Any disputes arising from these Terms or your use of the Platform shall be subject to the jurisdiction of the courts of Sri Lanka.
